The obligation of creating a website is imposed solely on joint-stock companies by Section 7(2) of Act No. 90/2012 Coll., on Business Corporations. The act further imposes an obligation on joint-stock companies to publish information on their website that they are otherwise obligated to disclose in their corporate documents. The act does not require limited liability companies to create a website, however, if they do so, the same rules governing websites of joint-stock companies apply to them.

Section 7(2) of Act No. 90/2012 Coll., on Business Corporations, stipulates the obligation of joint-stock companies to create a website. Joint-stock companies must create a website without undue delay after their foundation and they are obligated to publish all required information on the website on a regular basis. The law defines a website as a method of publishing, which allows remote access and is free for the public, whereas information should be available simply by entering the appropriate website address.

Joint-stock companies are obligated to publish information on their website that they are otherwise obligated to disclose in their corporate documents, as well as other information stipulated by law.

These namely include the basic identification data, e.g. trade name, registered office, ID number, information on the entry in the Commercial Register. Additional statutory documents to be published by a company on its website include, e.g. financial statements, financial assistance reports, invitations to the general meeting, information on association with a group and/or other necessary notices or communications for the shareholders.
